UN “FIT” TO SERVE?

 

Dire Situaiton

 

After 16 years in the military, a non-commissioned officer was four years away from retirement. At this point, the military was trying to discharge him due to over a dozen failures in the physical fitness program. Regulations require military members to be regularly tested for overall health and fitness. In most cases, even three failures mean an administrative discharge. The airman was not meeting standards.

 

Aggressive Representation

 

Ferah Ozbek fought back at the administrative discharge board. She clearly showed the board members that the military was not adhering to its own regulations. The airman was on and off the program for years. By cross-examining the government witnesses and bringing in witnesses who testified for the client, the board got a detailed picture of the entire case, not just the black and white “allegations.” The board voted to retain the airman.

 

Decisive Victory

 

This airman went on to serve honorably. He was able to retire after 20 years of service.
